1. CONTROLLER AND DATA PROTECTION OFFICER

As defined in art. 4 (7) EU General Data Protection Regulation (“GDPR”) Hovmand A/S, Sandvadsvej 15 A, DK-4600 Køge (“Hovmand”) is the data processor with regards to Hovmand’s processing of your personal data.

2. THE PROCESSING OF YOUR PERSONAL DATA

2.1 WEBSITE AND COOKIES

Every time you access our website, your Internet browser automatically transfers data and information (known as log data) to the web server of Hovmand: 

  • information about browser type and version,
  • operating system used,
  • referrer URL (of the previously visited site),
  • IP address of the enquiring computer,
  • access date and time of the server request, and
  • file request of the client (file name and URL).

The temporary storage of your IP address by the system is needed in order to make the website available to you. For this purpose, your IP address must be saved for the duration of website use. The legal basis for this processing is art. 6(1)(f) of the GDPR.

In addition, the above-mentioned personal data is also saved in log files to ensure functionality and security, as well as for website optimisation and statistics. However, your IP address is saved in an anonymised form, so it cannot be attributed to you as the user of this website.

The data collected to make the website available are deleted once the website session is terminated. Log files are deleted after 18 months at the latest.

Furthermore, we process your ordinary personal data in relation to our use of cookies on the website.

The legal basis for the processing of personal data in relation to cookies is your consent in accordance with art. 6(1)(a) of the GDPR.

If you give your consent to third party cookies (e.g. Facebook, LinkedIn or Google), we share your personal data with the respective third parties.

2.2 CONTACT REQUEST USING THE CONTACT FORM AND BY E-MAIL

When you contact Hovmand using the contact form on our website, via email or telephone, we process your ordinary personal data, including:

  • Company
  • Name
  • E-mail
  • Telephone
  • Country
  • Message (free text)

The personal data you provide is saved by Hovmand in order to process your request or answer your questions by e-mail or telephone.

The legal basis for the is art. 6(1) (f) of the GDPR. The purpose of processing is to deal with your request. If the purpose of your e-mail or message is to conclude an agreement or otherwise related to an existing agreement the legal basis is art. 6(1) (b) of the GDPR.

Hovmand deletes the personal data as soon as it is clear from the circumstances that your concern has been fully addressed or your question definitively answered. If there are statutory retention periods, Hovmand limits the processing in accordance with such local legislation. 

2.3 REGULAR INFORMATION ABOUT HOVMAND PRODUCTS AND SERVICES AND SPECIAL OFFERS (NEWSLETTER)

If you sign up to receive regular information free of charge by e-mail about Hovmand products and services, events and special offers (newsletter) you give your consent to the processing of your name and e-mail address for the purpose of direct marketing in accordance with art. 6(1)(a) and section 10(2) of the Danish Marketing act.

Hovmand uses the ‘double opt-in process’: Following your subscription to our newsletter, Hovmand sends an e-mail to the address given in which you are asked to confirm that you wish to receive information from Hovmand about its products and services, events and special offers. If you do not confirm your subscription, it will not be technically possible for Hovmand to send you a newsletter and Hovmand will delete your name and e-mail address after 30 days at the latest.

Moreover, we save details of your IP address and times of registration and confirmation. The purpose of this procedure is to be able to verify your registration and to clarify any misuse of your personal data where appropriate. The legal basis for this processing activity is art. 6(1)(f) of the GDPR.

Your e-mail address will be deleted when it is no longer required for this purpose. Hovmand therefore stores your e-mail address for as long as you wish to receive information about its products and services. This also applies to data processed for the purpose of verifying your consent (IP address and times of registration and confirmation).

You may withdraw your consent without charge at any time by e-mailing customerservice@hovmand.com, post or by using the unsubscribe link in each newsletter.

2.4 PROTECTED, EXCLUSIVE AREA FOR HOVMAND PRODUCT DEALERS

If your employer is a dealer of Hovmand products, Hovmand additionally offers you to log in on the website with the username and password provided to you by Hovmand.

In addition, the following is saved when you log in:

  • Username
  • Date and time

The personal data is processed on the basis of art. 6 (1)(f) of the GDPR.

Hovmand uses these data only to provide special content, in particular photos and documents related to Hovmand products that you as a dealer need for sales and marketing purposes.

The personal data is deleted when you are no longer employed by the dealer and hence, no longer have access rights to the portal.

2.5 RECRUITMENT

We process your personal data when you apply for a job at Hovmand. During the recruitment process we may process the following ordinary personal data about you:

  • personal data provided in your application material
  • personal data that we may collect from public online media, including for example LinkedIn, Facebook etc.
  • personal data we collect during interviews
  • personal data we may collect from references
  • personal data which appears from test results from person type tests etc.
  • Criminal records under specific circumstances

The legal basis for our processing of your ordinary personal data is our mutual legitimate interests in accordance with art. 6(1)(f) or your consent in accordance with art. 6(1)(a) of the GDPR.

If we request to obtain references, we will inform you prior to contacting any references who may have been provided in the application material.

We only collect ordinary personal data from you. However, depending on the data you – on your own initiative - have provided in your application material, we may process sensitive personal data (e.g. regarding health, political beliefs, trade union membership or sexual orientation) or your national identification number.

We kindly ask that you do not submit sensitive personal data in your application material unless you assess that it is strictly necessary.

To the extent that we process sensitive personal data about you, because you have provided this information in your application material on your own initiative, your submission of this information is considered as consent to our processing of the personal data during the recruitment process (invited applications), or until we have assessed whether or not we intend to save your application for a period of time (uninvited applications). 

As a starting point, we will save your application material up to 6 months after the end of the recruitment process (invited applications) or 10 days after receipt (uninvited applications). If your give us your consent, we will save your application for future vacancies for up to 2 years.

3. DISCLOSURE AND TRANSFER OF PERSONAL DATA

We do not share your personal data with third parties unless the disclosure is necessary for us to provide our service to you. When necessary, we disclose personal data to the following categories of recipients:

  • Data processors (e.g. hosting and other IT-service providers)
  • Group companies
  • Business partners and other service providers
  • Accountants or lawyers

If we disclose your personal data to third parties, we always make sure that we have a legitimate purpose and legal ground to do so.

If we disclose your personal data to third parties outside the EU/EØS, we make sure that we have a legal ground for the transfer in accordance with chapter V of the GDPR, for example the EU-Commissions adequacy decision in accordance with article 45 of the GDPR or the EU-Commissions standard contractual clauses in accordance with article 46(2)(c).

4. CONSENT

If we process your personal data on the basis of your consent, you have the right to withdraw your consent at any time. In this connection it is important to note that the withdrawal does not affect the lawfulness of processing based on your consent before the withdrawal. 

5. RIGHTS OF DATA SUBJECTS

When we process your personal data, you have the following rights as a data subject:

  • right to information, i.e. confirmation of whether personal data that concerns you are processed, and if yes, information about these data (art. 15 of the GDPR),
  • right to rectification and/or completion (art. 16 of the GDPR),
  • right to deletion (art. 17 of the GDPR),
  • Right to restriction of processing (art. 18 of the GDPR),
  • Right to data portability (art. 20 of the GDPR).
  • Right to object to the processing of your personal data (art. 21 of the GDPR)

If you wish to exercise your rights, you can contact us as described in section 1 above.

5.1. RIGHT TO LODGE A COMPLAINT

In addition, you have the right to lodge a complaint with a supervisory authority of your habitual residence or place of work or the headquarters of Hovmand in connection with the processing of your personal data by Hovmand. 6. SECURITY OF YOUR DATA

We use appropriate technical and organisational security measures to ensure the security of the data you provide to us. In particular, when assessing the level of protection, we take into account the risks associated with this processing on this website, and in particular, unintentional or unlawful destruction, loss, change or unauthorised disclosure and/or access to personal data that are transmitted, saved or processed in another manner.

This data privacy notice is currently valid and is dated 11/07/2022.
